I. General provisions

  1. These Terms and Conditions define the rules for using the website agnieszkaopala.pl (hereinafter: “Website” or “Store”) and the conditions for the sale of paintings offered through the Website.

  2. The owner of the Website and seller is Agnieszka Opala, email: agnieszkaopala@wp.pl, phone: +48 602 138 681 (hereinafter: “Seller”).

  3. Clicking the “Buy now” button and making a payment for a painting constitutes acceptance of these Terms and Conditions.

  4. These Terms and Conditions are made available free of charge on the Website in a manner that allows downloading, saving, and printing.

II. Definitions

  • Buyer — a natural person with full legal capacity, a legal person, or an organizational unit making a purchase through the Website.
  • Painting — an original painting by Agnieszka Opala offered for sale on the Website.
  • Order — the Buyer’s declaration of intent to conclude a sales contract for a Painting.
  • Contract — a sales contract for a Painting concluded between the Seller and the Buyer.

III. Ordering conditions

  1. Orders can be placed through the Website by clicking the “Buy now” button next to the selected Painting.

  2. Payment is processed through PayPal (PayPal (Europe) S.a r.l. et Cie, S.C.A.).

  3. Painting prices listed on the Website are gross prices expressed in Polish zloty (PLN).

  4. Shipping costs are added to the Painting price and are determined individually depending on the dimensions of the Painting and the delivery address. The Seller informs the Buyer of the shipping cost before concluding the contract.

  5. The sales contract is concluded upon receipt of payment in the Seller’s account.

IV. Order fulfillment

  1. After payment is received, the Seller confirms the order acceptance by email.

  2. The order fulfillment period is up to 14 business days from the date of order confirmation, unless the parties agree on a different deadline.

  3. The Painting is carefully packaged to ensure safe transport.

  4. Shipping is carried out via a courier service to the address provided by the Buyer.

  5. The risk of loss or damage to the Painting passes to the Buyer upon delivery.

V. Right of withdrawal

  1. In accordance with EU Directive 2011/83/EU on consumer rights and the Omnibus Directive (EU) 2019/2161, the Buyer who is a consumer has the right to withdraw from the contract without giving a reason within 14 days from the day of taking possession of the Painting.

  2. To exercise the right of withdrawal, the Buyer should inform the Seller of their decision by sending a clear statement to the email address: agnieszkaopala@wp.pl.

  3. In the event of withdrawal, the Buyer is obliged to return the Painting in an undamaged condition within 14 days from the day on which they informed the Seller of the withdrawal.

  4. The Seller refunds all payments received from the Buyer, including delivery costs (except for additional costs resulting from the Buyer’s choice of a delivery method other than the cheapest one), no later than within 14 days from the day of receiving the withdrawal statement.

  5. The Seller may withhold the refund until the Painting is received back or until the Buyer provides proof of its return — whichever event occurs first.

  6. The Buyer bears the direct costs of returning the Painting.

  7. Exceptions: The right of withdrawal does not apply to Paintings made to the Buyer’s special order (works created according to individual specifications), in accordance with applicable consumer protection laws.

VI. Complaints

  1. The Seller is obliged to deliver a Painting free from defects.

  2. The Buyer has the right to file a complaint if a defect in the Painting is found, in accordance with provisions on warranty and non-conformity of goods with the contract (EU Directive 2019/771).

  3. Complaints should be sent to the email address: agnieszkaopala@wp.pl, providing:

    • the Buyer’s name,
    • date of purchase,
    • description of the defect,
    • requested remedy (repair, replacement, price reduction, or withdrawal from the contract).
  4. The Seller processes complaints within 14 days of receipt.

  5. The Seller’s warranty liability covers defects found within 2 years from the date of delivery of the Painting to the Buyer.

VII. Out-of-court dispute resolution

  1. The Buyer who is a consumer may use out-of-court methods of handling complaints and pursuing claims, including:
    • filing a request for mediation with the appropriate provincial trade inspection authority,
    • filing a request for dispute resolution with a permanent consumer arbitration court,
    • using the ODR (Online Dispute Resolution) platform at: https://ec.europa.eu/consumers/odr.
  1. All Paintings presented on the Website are protected by copyright law.

  2. Purchasing a Painting means acquiring ownership of the copy (physical medium). Economic copyright to the work remains with the Seller, unless the parties conclude a separate agreement on the transfer of rights.

  3. The Buyer does not have the right to reproduce, copy, or commercially use the purchased Painting without the Seller’s written consent.

IX. Personal data

  1. The controller of the Buyer’s personal data is the Seller.

  2. Personal data is processed for the purpose of order fulfillment based on Art. 6(1)(b) GDPR (contract performance).

  3. Detailed information on personal data processing can be found in the Privacy Policy.

X. Technical requirements

  1. To use the Website, the following are required:

    • a device with Internet access,
    • a web browser supporting JavaScript and cookies,
    • an active email account.
  2. To make a payment, a PayPal account or a payment card supported by PayPal is required.

XI. Final provisions

  1. In matters not regulated by these Terms and Conditions, the provisions of applicable EU and Polish law shall apply, in particular the Civil Code, consumer rights legislation, and GDPR.

  2. The Seller reserves the right to amend these Terms and Conditions. Changes take effect on the date of their publication on the Website. Orders placed before the change are fulfilled under the previous terms.

  3. These Terms and Conditions are effective from February 25, 2026.
